Terms of service

TCast is a broadcast playout app for macOS, made by an independent developer. These Terms of Service are between you and Henry Kamstra, a sole proprietor doing business as TCast ("TCast", "I", "me", or "my"). These Terms are governed by the laws of the State of Colorado, United States. By downloading or using TCast, or by buying a TCast Pro license, you agree to these terms.

The license

TCast Pro is a one-time purchase. Your license lets you activate the app on up to two Macs at a time (for example, a main machine and a backup). You can deactivate a Mac from Settings to free up a seat and use the key on another one. If you lose access to a Mac and want to deactivate it, email support@tcast.app. Updates are included.

The free version and the 14-day trial are covered by the same terms, minus the payment parts.

You may use TCast for any lawful purpose, personal or commercial. You may not resell, sublicense, or share your license key, and you may not attempt to bypass the license system.

Payments

Purchases are handled by Stripe, who acts as the merchant of record. Stripe handles payment processing, invoices, and sales tax, and is the seller on record for the transaction itself. Checkout, your receipt, and your card statement show Link, which is Stripe's. Stripe's consumer terms apply to the purchase.

Refunds

See the refund policy. Short version: 14 days, no hard feelings.

No warranty

TCast is provided as-is. I work hard to make it reliable, but I can't guarantee it will be free of bugs or fit for any particular purpose. Test your setup before you go live, and send bug reports in the app if something breaks.

Limitation of liability

To the maximum extent permitted by law, my total liability for any claim related to TCast is limited to the amount you paid for it. I'm not liable for indirect or consequential damages, including lost profits or interrupted shows. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you, and nothing in these terms overrides consumer rights granted to you by mandatory law.

Termination

If you materially breach these terms (for example, by distributing license keys), your license may be revoked. Your local media and projects are always yours as the app keeps playing your existing content on the free tier even without a license.

Copyright complaints

The upload inbox briefly stores files people send to a TCast user. If you believe material stored through TCast infringes your copyright, email a notice to support@tcast.app (designated agent: Henry Kamstra).

A valid notice includes: your physical or electronic signature; identification of the copyrighted work; identification of the material and where it is (the upload link); your contact details; a good-faith statement that the use isn't authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the notice is accurate and you're authorized to act for the owner.

I'll remove or disable access to the material promptly. The uploader may send a counter-notice with the elements required by 17 U.S.C. §512(g)(3). Repeat infringers lose access to the upload service.

Changes

If these terms change, the new version will be posted here with an updated date. Changes won't take away a license you already paid for.
